“We’re seeing some other games that we generally rely on a great deal dissipate,” commission member Morgan Beam said at the quarterly meeting. “We’ve talked for hours on end … I don’t see that path without some technological advancements in different types of games.”

A commission subcommittee already has been looking at digital instants, which now are played in five other states. The North Carolina lottery already lets players buy tickets through its website for big biweekly or daily jackpot drawings. Gamblers can pay to play by using their debit cards or checking accounts.

A preliminary report by lottery fiscal staff projects digital instant sales could reach $780 million annually in its fifth year. The North Carolina Education Lottery sold nearly $2.9 billion in tickets during the last fiscal year, resulting in $708 million for public education — both records.

Commission members voted to direct lottery staff to present a business plan soon for digital instants that includes staffing needs, sales details and a timeline. They also want to hear from retail groups in the handful of states that already have such online games about whether they hurt in-person sales at grocery and convenience stores. Commissioners said a final vote to offer the games to the public still would be required.

The lottery presented data showing scratch-off ticket sales have kept growing in states that have also introduced digital instants. But the North Carolina Retail Merchants Association told commissioners it’s not convinced, saying lottery sales in states without digital instants are growing at or above what lotteries with digital instants are doing.

“If a current lottery player can sit at their residence on a Saturday and play an online lottery game over and over without leaving the comfort of their home, then traditional lottery retailers will eventually lose sales to this activity and it will be too late to reverse course,” association president Andy Ellen wrote.

North Carolina lottery leaders want to match other states that offer them and “tap a new generation of players comfortable with computers and mobile phones,” The AP reports.

But there’s a problem: The digital instant themes and screens look a lot like the like video sweepstakes games that legislators and law enforcement have tried for years to stamp out. Stein says they may qualify as video games that have been banned under separate state laws.

“The commission lacks authority to offer lottery games that qualify as video games,” he wrote in a Jan. 22 letter, pointing to legal citations.

“I am concerned that these types of games prey on vulnerable people and risk real harm to both communities and families across the state,” Stein wrote, urging the commission to oppose the online expansion.

The association representing the state’s police chiefs is also opposed to digital instants. Legalizing them “would make it virtually impossible” to enforce the current sweepstakes ban because players could click on lawful or internet games, said Roxboro Police Chief David Hess, president of the North Carolina Association of Chiefs of Police.

Lottery officials say the two types of games aren’t the same and the authorized online games would be under the state’s control and heavy regulation.

So, on the one hand, North Carolina lawmakers and authorities have been trying for years to eradicate illegal video sweepstakes parlors amid anecdotes of players, particularly in poor areas, emptying their wallets to play.

And on the other hand, the Lottery Commission is considering online games that look suspiciously like video sweepstakes. But that’s OK because the state is going to regulate them heavily — and rake in piles of cash.

Lottery officials estimate that digital instants could generate $80 million in net proceeds annually within five years. The state lottery earned $708 million for public education during the 12 months ending last June.

Like the current limited online ticket sales already allowed, digital instants would require minimum-age verification and set limits on money transfers to ticket purchase accounts.The North Carolina Retail Merchants Association opposes the expansion over concerns that online games might cannibalize sales for traditional lottery ticket sellers.

The debate has at least one positive effect: it’s helping to bridge the political divide. Both the liberal-leaning North Carolina Justice Center and the conservative John Locke Foundation oppose the expansion.

With the attorney general, police chiefs, retail merchants and groups across the political spectrum raising red flags, that’s a sign that North Carolina should put the brakes on expanding state-sponsored online gaming.

Act 42, which the state Legislature passed in 2017, expanded the number of games for the lottery to offer.Here’s a breakdown of some of the numbers:

? Scratch-off games earned a record of more than $2.9 billion, 66% of all sales.

? Sales of multi-state games — Powerball, Mega Millions and Cash4Life — grew by more than $82.2 million, more than 19% over last year.

? In the first year of iLottery, online gaming revenue totaled more than $381 million, with more than 91,100 new online accounts. The iLottery prizes exceeded $332 million.

? Keno and virtual sports games played in bars totaled almost $47 million in sales.

The results are based on the fiscal year, July 1, 2018, to June 30, 2019.

“We are thrilled that the new and exciting games that were authorized by Act 42 of 2017 are proving to be a tremendous success,” Mr. Svitko said. “We’re always working hard to find innovative ways we can responsibly grow profits to benefit older Pennsylvanians.”

A cash advance typically refers to a person withdrawing cash from an ATM machine on a credit card. Banks usually charge a fee for the service, which can range from $3.50 to $10.

Staruch said she contacted OLG about the $3.50 surcharge, and a customer service representative said it was imposed by her bank. She said an RBC representative then told her OLG was responsible for the fee because the company had set up billing as a cash advance.

“I just would hate to see all these people being surprised. Some people don’t even look at their credit card statements. It’s ridiculous that you’re paying $6.50 for a $3 lottery ticket.”OLG spokesperson Ryan Bissonnette told the Star that the company does not charge any fees when people buy lottery tickets online, or deposit funds into their online player accounts.

“We clearly state that additional fees could be applied by their financial institutions. That’s something that you can’t miss,” Bissonnette said.

He explained that online customers can use debit cards, Visa or Mastercard credit cards, or Visa debit cards on the PlayOLG website. When someone deposits money into an online account using a credit card, the website includes a warning that “cash advance fees may apply,” he said.

The PlayOLG.ca Terms and Conditions, which players must agree to in order to create an account, also state that “some credit card issuers may treat the funding of a Player Account as a cash advance and charge a fee for each such credit card transaction. Any cash advance fee or other fees relating to the use of a credit card are the Player's sole responsibility.”

“This is not in the fine print. It’s very prominently displayed on our page,” Bissonnette added.Lena Wan, an RBC communications representative, told the Star that gaming transactions, “such as the purchase of lottery tickets, betting and casino gaming chips,” are considered cash-like transactions.

“As such, these types of transactions are treated as cash advances by some credit card issuers,” she said in an e-mail, urging RBC clients to check with the bank if they are unsure about the status of a purchase.

Caroline Van Hasselt, director of media relations at CIBC, said the bank considers using a credit card for gaming purposes “cash like,” and therefore also bills it as a cash advance.

“If the merchant is classified as a ‘quasi-cash merchant’ like a lottery kiosk and you’re paying with your credit card, it’ll appear as a cash advance on your statement,” she said. “If our client has encountered it for the first time and was surprised, we can reverse the charge.”
